In 2018, Governor Brown signed Senate Bill 901 (Dodd, Chapter 626, Statutes of 2018), which addressed a wide range of issues relating to wildfire prevention, response, and recovery.

Senate Bill 901 substantially revised the Public Utilities Code Section 8387, eliminating the prior process established by SB 1028 and instead mandated all Publicly-Owned Utilities (regardless of size or wildfire risk) to develop a wildfire mitigation plan (WMP).

Pursuant to the amended Section 8387, all Publicly-Owned Utilities (POU) must prepare a wildfire mitigation plan prior to January 1, 2020, and update it annually thereafter.

Section 8387(b)(2) specifies WMPs shall consider as necessary, certain specified elements. The “consider as necessary” clause indicates that if certain elements do not apply to a community, such as communities with significant underground facilities or extremely limited tree canopy, then certain elements can be eliminated or minimized, with an explanation.

POUs are also required to have their plan reviewed by a qualified independent evaluator to assess the comprehensiveness of the plan, and to publish both the WMP and the evaluator’s report on the POU’s website.

Senate Bill 2 of the First Extraordinary Session ("SBX1 2") requires all load serving entities in California to achieve a 33% Renewable Portfolio Standard ( RPS) by 2020, with interim targets of an average of 20% through 2011- 2013, 25% by 2016 and 33% by 2020.

Additionally, SBX1 2 requires publicly owned utilities ( POUs) to develop a procurement plan and to adopt an enforcement program ( by 1/1/2012). This renewable resources procurement plan and enforcement program ("SBX1 2 Compliance Plan") represents the City of Vernon' s commitment to renewable energy procurement consistent with the legislative intent of SBX1 2.

Assembly Bill 802 (Williams, 2015) directed the California Energy Commission to create a statewide building energy use benchmarking and public disclosure program for buildings larger than 50,000 square feet. The Commission's regulations require building owners to report building characteristic information and energy use data to the Commission by June 1 annually, beginning in 2018 for buildings with no residential utility accounts, and in 2019 for buildings with 17 or more residential utility accounts. Building owners will complete their reporting using ENERGY STAR Portfolio Manager, a free online tool provided by the United States Environmental Protection Agency.

Assembly Bill 802 also requires, effective January 1, 2017, that energy utilities provide building-level energy use data to building owners, owners' agents, and operators upon request for buildings with no residential utility accounts and for buildings with five or more utility accounts.

Under the law, building owners (or authorized agents) are allowed to obtain the total energy use data for their building, in most cases without obtaining authorization from their tenants. A Tenant Consent Form is required when:

• Building has fewer than 3 commercial active utility accounts
• Building has fewer than 5 active utility accounts and at least one of which is residential

Individual, tenant-specific meter data will be made available to building owners with individual consent and authorization from each tenant in the building.

VPU will provide aggregated, whole-building data within 15 days of receipt of the Building Energy Use & Public Disclosure Program Form and Tenant Consent Form, if required.
